Suu Kyi ?can be Burma president?






Burmese leader Thein Sein has told the BBC he would accept Aung San Suu Kyi as president if the people vote for her.

The president insisted that the will of the people would be respected whoever they chose in an election due in 2015.

He reiterated his commitment to the country?s reform programme, and said he and Ms Suu Kyi were working together.

Thein Sein, a former leader of the military junta that ruled Burma for decades, has overseen a dramatic shift towards a civilian-led government.

Two days ago he spoke at the UN General Assembly, congratulating Ms Suu Kyi on receiving the US Congressional Gold Medal.

In an interview with the BBC?s HardTalk programme, he went even further by talking about the possibility of the Nobel Peace Prize winner becoming president.

?Whether she will become a leader of the nation depends on the will of the people. If the people accept her, then I will have to accept her,? he said.

?There isn?t any problem between me and Aung San Suu Kyi. We are working together.?

But he added that the army, which retains many of the seats in parliament, will continue to play a central role in the country?s politics.

Ms Suu Kyi was kept under house arrest for 15 years and repeatedly denounced by the former regime.

Thein Sein?s remarks this week have been the warmest from Burma?s political leadership since the junta was formally dissolved in March 2011.

But Burma still faces many problems, including a recent outbreak of fighting between Muslim Rohingya people and Buddhist Rakhine people.

The president has repeatedly pledged to end internal strife, but neither he nor Ms Suu Kyi have provided a possible solution to the problems in Rakhine state.

Meanwhile, the president also renewed his appeal for economic sanctions placed on his country to be lifted.

US Secretary of State Hillary Clinton has already said the US would ease its import ban on Burmese goods.

Many other targeted measures have already been lifted by the US and other Western countries.

Why the Candidates Should (But Won?t) Stipulate

Take the day in 1992 when both Republican Senator Warren Rudman and Democrat Paul Tsongas made headlines declaring that everybody was at fault for the country?s fiscal condition at the time, from then-President Bush to the democrat-controlled Congress, to the American people. Responsible economists later credited Rudman and Tsongas for spurring reforms that helped lead to the Clinton era surpluses.

Around the same time, retired senator and conservative eminence gris Barry Goldwater denounced the followers of ?migr? philosopher Leo Strauss ? so-called ?neocons? ? for hijacking Goldwater?s beloved movement over cliffs of romantic delusion. A more recent example of post retirement candor came When G.W. Bush?s ex-Treasury Secretary, Paul O?Neill, revealed a swamp of backroom dealings and ineptitude, explaining that he was ?old and rich? and unafraid to speak his mind. On the other side, some claim that Senator Joe Lieberman really came into his own when he ran as an independent, shrugging off party discipline (if such a thing exists, among democrats.)

CONTRARY BRIN

The article goes on to point out that candor is almost suicidal under the rules of our current system. Excellent thought. What I found more interesting was Brin?s awareness of Leo Strauss, the man behind the curtain of much of the modern Neoconservative movement. I wouldn?t have expected a scientist to have read so deeply into politics.

Yes, Strauss is mentioned in the histories you can find on the web about Neoconservatism but few point out his critical role in the movement, nor do they emphasize the manipulative nature of his teaching. The articles talk about Strauss teaching about a return to Classical values ? this is utter nonsense, Strauss was designing a new political elite from his students, manipulative and power hungry. We will be dealing with his minions for decades to come. He planted the dragon seeds that bedevil our foreign policy even today. And they will be pulling many other strings as well.

So, Mr. Brin has impressed me and I wish him well. I think we share many of the same thoughts.

Israelis see no Iran war this year after Netanyahu's speech

JERUSALEM (Reuters) - Prime Minister Benjamin Netanyahu's U.N. speech about Iranian nuclear advances has dampened speculation in Israel that he could order a war this year.

Analyzing Thursday's address in which Netanyahu literally drew a "red line" on a cartoon bomb to show how close Iran was to building nuclear weaponry, commentators saw his deadline for any military action falling in early or mid-2013, well after U.S. elections in November and a possible snap Israeli poll.

"The 'decisive year' of 2012 will pass without decisiveness," wrote Ofer Shelah of Maariv newspaper on Friday.

Without explicitly saying so, Netanyahu implied Israel would attack Iran's uranium enrichment facilities if they were allowed to process potential weapons-grade material beyond his red line.

Maariv and another mass-circulation Israeli daily, Yedioth Ahronoth, said spring 2013 now looked like Netanyahu's target date, given his prediction that by then Iran may have amassed enough 20 percent-enriched uranium for a first bomb, if purified further.

But the front pages of the liberal Haaretz and pro-government Israel Hayom newspapers cited mid-2013 - Netanyahu's outside estimate for when the Iranians would be ready to embark on the last stage of building such a weapon, which could take only "a few months, possibly a few weeks".

Iran, which denies it is seeking nuclear arms, said Netanyahu's speech made "baseless and absurd allegations" and that the Islamic Republic "reserves its full right to retaliate with full force against any attack". Israel is widely assumed to have the Middle East's only atomic arsenal.

Israeli diplomats were reluctant to elaborate on Netanyahu's speech, saying its main aim was to illustrate the threat from Tehran.

Asked on Israel's Army Radio whether Netanyahu had signaled he would strike in the spring if U.S. and European Union sanctions fail to curb Iran's nuclear work, Foreign Minister Avigdor Lieberman said: "No, no, I would not go that far."

"The prime minister clarified a message to the international community (that) if they want to prevent the next war, they must prevent a nuclear Iran," Lieberman added.

TRUCE WITH OBAMA

Netanyahu's increasingly hawkish words on Iran in recent weeks and months strained relations with U.S. President Barack Obama, who has resisted the calls to set Tehran an ultimatum while fending off charges by his Republican rival, Mitt Romney, that he is soft on Israel's security.

Netanyahu praised Obama's resolve in his U.N. address, which the prime minister described as advancing their "common goal" - a strong signal that Israel would not blindside Washington with a unilateral attack on Iran.

Israel Hayom pundit Dan Margalit said the speech constituted "an almost explicit acknowledgment that he (Netanyahu) is declaring a truce in the public argument between him and the president. At least, until after the (U.S.) election."

Netanyahu has political worries too, given deadlock in his coalition government over the 2013 budget which, if not ratified by December, could trigger an early Israeli election next year.

In a broadcast editorial, Army Radio depicted war with Iran as no longer an imminent dilemma troubling the prime minister.

Instead, the station said, Netanyahu would have to decide "whether he is going to elections sooner, in January, February, or maybe March, or whether he will be able to pass the budget, take care of the Iranian issue and then go to elections in October (2013) as scheduled."

U.S. Defense Secretary Leon Panetta said this month that Washington would have "about a year" to stop Iran should it decide to cross the threshold of producing nuclear weaponry - a more expansive timeline than that put forward by Israel.

That could spell fresh clashes between the allies over Tehran's continued 20-percent uranium enrichment, a process the Iranians say they need for medical isotopes but that also brings the fissile material much closer to weapons grade.

An Israeli official briefed on the government's Iran strategy cautioned against interpreting dates Netanyahu gave at the United Nations as deadlines, saying the preparations had already been made for military strikes.

"When he says Iran will have a bomb by this-or-that point in time, that in no way means the war option must wait until then," the official told Reuters. "There are other considerations to the timing - operational and strategic."

Venice Lagoon research indicates rapid climate change in coastal regions

ScienceDaily (Sep. 28, 2012) ? Research undertaken by the University of Southampton and its associates in Venice has revealed that the sea surface temperature (SST) in coastal regions is rising as much as ten times faster than the global average of 0.13 degrees per decade.

Researchers believe that this is partly as a result of a process known as the 'urban heat island effect'; where regions experiencing rapid industrial and urban expansion produce vast amounts of heat, making the area warmer than its surroundings.

Professor Carl Amos of Ocean and Earth Sciences at the University of Southampton, will be making a speech at the Estuarine & Coastal Sciences Association's Research & Management of Transitional Waters international symposium, in Lithuania on September 27. He explains: "The urban heat island effect is a little considered problem with extreme consequences. Take London for example; the air temperature in the capital and the SST of the Thames is always warmer than it is in the rest of the UK. Similarly, in South Korea, an area which has seen rapid industrial expansion, the SST is rising at a rate of 0.26 degrees per decade -- significantly higher than the global average. Two thirds of this rise is explained by local air temperature, which is largely driven by the urban heat island effect."

The world's coastal zone occupies 18 per cent of the world's land mass and it is estimated that 1.6 billion people live in these regions world-wide. The coastal population density is three times the global average and this population is expected to increase 30 per cent by 2025, with trade and infrastructure at the coasts also increasing steadily. Research suggests that in coastal regions of high urban development, human activity is directly warming adjacent coastal waters and that this contribution to global warming at the coastal zones is equal to, or greater than, other factors such as greenhouse gasses.

Professor Amos, who is based at the National Oceanography Centre Southampton (NOCS) says: "The Marine Climate Change Impacts Partnership Report of 2006 stated that the capacity to define and predict long-term coastal changes due to human causes is 'unknown' and confidence in results is 'low'. This is a major barrier to planning for inevitable changes in coastal SST. Most of these changes at coastlines are caused by human activity, but as it is complex to consider these factors accurately, the official International Panel for Climate Change (IPCC) figures do not take these coastal 'anomalies' into account."

In Venice, with 22 million visitors annually and tourism a year-round source of income, the economy remains critically dependent on the city maintaining its status as one of the world's most desirable destinations. Southampton's research in Venice has highlighted the tension between tourism's economic benefits and environmental repercussions. Analyses of seawater temperature trends in the Venice Lagoon have suggested an increase during winter months ten times greater than that predicted globally by the IPCC -- a result directly linked to tourism.

Thousands of jobs and the Venetian economy rely on the survival of the fishing industry, which is dependent on the temperature of the coastal seawater in the Venice Lagoon. A rise in SST in the coastal zone reduces oxygen levels and displaces marine fish and associated nursery grounds, causing catastrophic fish kill phenomena. This research has helped predict the viability of clam fisheries and aquaculture habitats that serve the restaurant trade that caters for millions of tourists every year.

Professor Amos says: "The findings in Venice are the result of a 15 year partnership with the city, which are of great importance and have worldwide applications. Massive urbanisation of the coastal zones means urban heat islands represent an acute problem, particularly for the fishing industry and also for the maintenance of coastal infrastructure. The Thames, like the Venice Lagoon, is a major contributor to and casualty of the urban heat island effect. The consequences of the urban heat island effect need addressing urgently to secure the future of our coastal habitats."

SKorea: Japan must educate its people about WWII

NEW YORK (AP) ? South Korea's foreign minister said Thursday that Japan's wartime past will overshadow relations between the two staunch U.S. allies until Japan educates its people about crimes committed during colonial rule.

In an interview with The Associated Press on the sidelines of the U.N. General Assembly, Foreign Minister Kim Sung-hwan said: "We are victims of Japanese colonial rule."

Kim, speaking a few hours before "serious" talks with Japan's foreign minister, also said South Korea would not compromise in its dispute over the tiny Dokdo islands, called Takeshima by Japan, which has further strained ties.

"When the Japanese government claims Dokdo is their territory, Korean people (take) it as another attempt to invade our country," Kim said. "So that's the Korean sentiment and I hope that the Japanese government understands this."

But he said South Korea recognizes its shared interests with fellow-democracy Japan, such as coping with North Korea and its nuclear ambitions. Both Japan and South Korea play host to tens of thousands of U.S. troops.

Kim said Seoul wants to expand relations with Japan, including in military cooperation, but only if South Korean public sentiment allows it. In June, they put on hold an intelligence sharing pact after it provoked an outcry in South Korea.

"We have to try to overcome these differences. It's up to the Japanese attitude. While they maintain their attitude ... there should be some limit on the scope of cooperation," he said.

Japan occupied the Korean peninsula for 35 years until the defeat of fascist forces in World War II and also occupied much of China. Japan issued a formal apology in 1993 over its use of Korean women as sex slaves by its soldiers during the war, but has failed to convince South Korea it is truly contrite.

Kim accused Japanese politicians of denying war crimes and said Japan's failure to educate its people properly about the past was the root cause of its various territorial disputes over islands in the region ? including with Russia and Asia's premier power, China.

"It's in sharp contrast with what Germany did to get the support and respect from the neighboring countries" after World War II, Kim said. "If Japan does it, I'm sure they can (get) respect from neighboring countries."

The dispute escalated last month when South Korean President Lee Myung-bak made an unprecedented visit to Dokdo, which drew unusually stern criticism from Japan. South Korea has rejected a Japanese proposal for the dispute to be settled in the International Court of Justice.

On Wednesday, Japanese Prime Minister Yoshihiko Noda stuck by Japan's stance on the islands, but said it did not want it to adversely affect relations with South Korea.

The issue stirs particularly strong nationalist passions among Koreans, as Japan's takeover of Dokdo in 1905 presaged its annexation of Korea five years later. South Korea took the islands back in the early 1950s and deploys police there.

Kim and Japan's Foreign Minister Koichiro Gemba discussed the island dispute and historical issues including "comfort women," in their 30-minute meeting Thursday, said Japanese ministry spokeswoman Naoko Saiki. She would not disclose the substance of the exchanges but characterized them as "serious."

Saiki said they also discussed North Korea, and that despite the current difficulties between Japan and South Korea, the ministers agreed they have to cooperate and strive for "stable, forward-looking relations."

In the interview, Kim said that South Korea remains open to better relations with North Korea, and that it was disappointed when its offer earlier this month to provide flood relief to North Korea was rebuffed as inadequate by Pyongyang.

He also said that since North Korea's failed attempt in April to launch a satellite, "Trust has regressed." The unsuccessful launch was deemed by the U.S. to have military implications and to violate prior agreement by North Korea to suspend ballistic missile testing.

In spite of North Korea's new leader, Kim Jong Un, setting a somewhat more modern and open style, there has been no practical improvement in relations with South Korea or the United States with Pyongyang.

The United States, China and South Korea are all going through elections or leadership changes late this year, Kim noted, suggesting that any significant resumption of diplomatic activity with North Korea may have to wait.

Besides being masters of serving high quality meals, Dennis Johnston and Monica Bauch?, proprietors of Fid Resto (1569 Dresden Row, 422-9162), have proven themselves keenly aware of their place in the Hali restaurant market, and have extended their core business into interesting and creative side lines. Last spring, the restaurant started serving ?back door Pad Thai?---anytime the kitchen?s open, which is from 11:30am through the evening hours, you can simply knock on the Queen Street kitchen door and ask for an order of Pad Thai to go, and the cooks will whip it up for a mere 10 bucks. Bauch? says the back door Pad Thai has been wonderfully successful but, thinking of the coming change of season, wonders if people will continue to come when it means waiting outside in the cold. Then, she answers her own question: ?A lot of people call ahead to order, so they don?t have to wait. Or, if there?s room, they can sit at the bar.? Problem solved. It?s also time to start thinking of signing up for Johnston?s cooking classes, either Thai or French cuisine, generally taught on Mondays when the restaurant is closed, but possibly other days, depending on how fall hours get established. The classes are hands-on, and are not simply a ?watch Dennis cook? affair: students handle the food and kitchen equipment themselves, as Johnston walks them through an appetizer, a main course and a dessert, then the group sits down and eats their creations. Bauch? says that wannabe students can wait til the classes are officially offered, but it makes sense for those interested to start forming their own groups---at least six people, but only 10 can fit in the Fid kitchen---now, and calling the restaurant to figure out a mutually agreeable schedule. I can?t think of a better excuse for a weekly friend outing. And---how sad is this?---it?s already time to begin making plans for the workplace holiday events. Bauch? suggests a night at Fid. A typical company outing might be consist of 30 employees, split into three groups of 10, each rotating through a cooking class in the kitchen, a lesson in drink-making behind the bar and a wine-tasting on the other side of the bar. The defining word here is ?flexible.? It?s striking how much Johnston and Bauch? are willing to work with customers to make everyone happy. On their 12th year of business, with that attitude, they?ll no doubt continue their success.

Romney Calls GDP Growth 'Unacceptable,' Pledges to Halt Defense Cuts

SPRINGFIELD, VIRGINIA -Republican presidential nominee Mitt Romney called today's revised GDP numbers showing slower growth "unacceptable."

"Look at the numbers that just came out on the growth of our economy," Romney said at an American Legion Post in Springfield, Virginia, "1.3% versus Russia at four percent. China at seven to eight percent. We're at 1.3% - this is unacceptable. It is not working."

The overall economy grew at an annual rate of 1.3 percent in the spring, down from its previous estimate of 1.7 percent growth, according to data released Thursday by the Commerce Department.

The revised numbers gave Romney room to draw a comparison between himself and President Obama.

"I know what it takes to get us working," he said, "This is a real challenge for us. And this is not just one quarter. This has been going on now for years. China's growing much faster than we, Russia's growing faster than we. Our economy needs to be reinvigorated."

The economic news complimented the main message of the governor's visit with veterans today, to hammer the administration on the looming and drastic $500 billion in defense cuts, among other feral spending cuts, that will take place next year due to sequestration if Congress does not find a way around them.

"You have to have a strong economy to build a strong military," he said, blaming the Obama administration. "The White House proposes sequestration, kind of a gun to your head opportunity which is that congress couldn't get the job done properly and the president couldn't lead them?strange proposal in the first place, even stranger that it's being put in place."

Romney did not mention that some of his Republican colleagues on Capitol Hill were the ones that helped negotiate the deal with the White House and who ultimately voted the deal through Congress.

Virginia, which is home to the Pentagon, is poised to be hit especially hard by the cuts.

Over 136,000 jobs from major defense sites in the state of Virginia could be cut if Congress does not figure out an alternative. Romney said the job loss would be as "devastating" as the effect on the nation's security if sequestration is allowed to happen.

"It is still a troubled and dangerous world," Romney said, "And the idea of cutting our military commitment by a trillion dollars over this decade is unthinkable and devastating."

Romney asked for help in the battleground state, noting that "we've got to win in Virginia."

The governor told a story that would appeal to his audience, getting choked up when he spoke about a veteran he met while greeting an Honor Flight that he met on the tarmac on Toledo, Ohio last night. The group flies WWII and Korean War veterans to Washington, D.C. for a day to visit the monuments. Romney said one of the last veterans he met last night, an elderly World War II veteran in a wheelchair, really touched him.

"He turned to go through this long alleyway that had been set up with flags and people who were there to recognize each of the veterans. But he stopped the person who was pushing them, pushing him in the wheelchair. And then he reached inside his coat and took out a flag. And waved it. And we all applauded."

Since the iPhone 5 hit store shelves on Friday, complaints about the propensity of the?device's paint?job to scratch and chip have started flooding in.?But according to an email exchange Apple senior vice president of marketing Phil Schiller allegedly had with a customer such cosmetic issues are "normal."

According to?9to5 Mac's Seth Weintraub, one of the blog's readers sent an email to Schiller, pointing out that his iPhone 5 is showing "some scuffs, scratches and marks throughout the band around the phone."?He asked what he and others who are seeing this issue can do and whether there are any plans to fix it.

The reply Schiller sent, according to this customer, explained that "[a]ny aluminum product may scratch or chip with use, exposing its natural silver color. That is normal."

Schiller's somewhat brief?reply reminds us?of the time when late Apple co-founder Steve Jobs told a?customer who complained about the iPhone 4 reception issues he experienced when his hand covered the device's antennas that he should "[j]ust avoid holding it that way."

Of course, that email preceded what is now referred to as "Antennagate" and?a press conference during which Apple addressed these reception issues and offered every iPhone 4 owner a free "Bumper" case.

Just like the iPhone 4 reception issues reported back then, the cosmetic issues reported in the last few days?appear to only affect some iPhone 5 owners. NBC News tech?editor Wilson Rothman and I got the?iPhone 5 on the same day,?but while his is already showing wear (as you can see in the images above) after spending time in and out of his jeans pocket, my own device, also black, is still in pristine condition. And that's after it?spent a lot of time in a purse pocket along with other smartphones, loose change and my house keys.

Because of the strange way our experiences parallel the iPhone 4 reception woes, we can't help but wonder if we'll soon be hearing more on this,?possibly even from Apple, which has yet to reply to our inquiry. Given the fact that you can't upgrade hardware as easily as software (or maps), there's certainly a chance of a "Paintgate" in our near future.

Thomas Cohn: Legal Challenges For Online Affiliate Marketing ...

Welcome to this interview of Thomas Cohn, a well-known consumer regulatory attorney, former Federal Trade Commission?(FTC) Regional Director, and 17 year FTC veteran. At Affiliate Management Days East 2012 (on Oct 9-10, 2012), Thomas will be speaking on FTC and State actions versus affiliates and merchants and how to comply with consumer laws to avoid regulatory scrutiny.

Question: What are the major affiliate marketing threats that you have seen evolve over the past few years on the legislative front?

Thomas: ?There?s a big direct threat on the state level (sales tax legislation). ?On the federal level, there are only indirect threats such as the limited situations in the ?Rockefeller Bill? that became ROSCA.

Beyond legislation, there are new FTC regulations implementing legislation, like the MARS Rule (banning advance fees for mortgage assistance) and the Business Opportunity Rule (more stringent disclosure requirements, covering more types within definition).

But the threat even bigger than legislation or regulation, is simply the continual increase in enforcement actions by state AGs and the FTC against deceptive online marketing, and against the roles played in it by not just merchants, but also affiliates, networks, and others who allegedly play a role in helping to apply the deceptive practices against consumers.

Question: Can you give us an example of a case involving legal compliance?

Thomas: The actions that FTC has brought in the last 12 months have highlighted the FTC?s awareness of deceptive tactics in affiliate marketing, and its increasingly aggressive stance in going after them. ?Whether they involve merchants, affiliates, networks, or other third parties whom the FTC believes are ?assisting and facilitating? these tactics.

This includes FTC cases against merchants like Central Coast Nutraceuticals, Jesse Willms and LeanSpa. ?The ten FTC cases brought against individual affiliate marketers, and the two FTC cases against affiliate networks.

Other third parties may be vulnerable, too: lead generators, list brokers, payment processors and call centers have all been targeted by the FTC. ?There may be more investigations and/or actions against such third parties.

Question: What can affiliate managers merchants do to ensure? compliance with the laws and avoid regulatory scrutiny?

Thomas: Take a look at the enforcement actions cited above that have final orders requiring monitoring, and see how onerous these are to actually implement! ?Then realize that while these don?t apply to everyone, just to the named defendants, you should still consider them in your risk calculus.

Finally, come up with a robust monitoring program that you actually can and will follow, by checking out both merchants and their offers, and affiliates? published content, before doing business with them.

Then, after offers start running, periodically check up on at least those merchants and affiliates that are performing the best, to see just why they are the top performers. ?Are there any deceptive/false/unsubstantiated product claims, including testimonials/endorsements? ?Are there deceptive formats? ?Are there inadequate or missing negative option/free trial and/or continuity/rebill disclosures?

If so, either enforce modifications or terminate the relationship.

Question: What can the affiliate marketing industry do to ensure its growth, regardless of the emerging legislative challenges?

Thomas: Same as above. ?Make sure both merchants and affiliates stay as compliant as possible, or stop doing business with those who don?t. ?The best way to ensure growth is to stay on top of the content being published by reasonably monitoring merchants? and affiliates? advertising.

While online privacy is a perennial hot topic, affiliate marketers and affiliate networks may not be affected much by whatever behavioral targeting legislation is eventually passed. The more immediate privacy-related issue is data security. ?If you ?say what you do? with your consumer data, then you better ensure that you ?do what you say.?

Any major hacking attack or other data breach could quickly bring an FTC investigation and/or enforcement action.

Question: If you were to leave affiliate managers with just one piece of advice today, what would it be?

Thomas: Compliance monitoring.?It doesn?t have to be perfect, but has to be reasonable and consistently implemented.

The FTC doesn?t care about cloaking/masking or other difficulties that affiliate networks/managers face in monitoring affiliates. The FTC?s view is that, if network profits are based on traffic that converts, then the network must do better to ensure compliant affiliate content.

Along the full length of the galaxy, and scattered around parts of its halo, are bright pink nebulae. Similar to the Orion Nebula in the Milky Way, these are clouds of gas that are gradually coalescing into stars. The powerful radiation from the stars excites the gas and makes it light up, much like a fluorescent sign. The large number of these star formation regions is a telltale sign of gravitational interaction.

The dark filamentary structures that are scattered along the length of the galaxy are caused by cold interstellar dust blocking some of the starlight.

Hubble's image is a combination of exposures in visible light produced by Hubble's Advanced Camera for Surveys and the Wide Field and Planetary Camera 2.

Q: Hello?4 Weeks ago we were presented with a cash offer and given 25000 earnest money to hold the deal. 2 days before we were supposed to close the buyer stated she was unable to obtain the funds and wanted an extension of 3 Weeks. She has not signed an extension letter its been 11 days since our closing date?.our realtor told Us that in Order to get the earnest money we would have to take her to court because it?s over 8000?.we meet every contingency we are living in an apartment and we already wrote our builder a check to begin our new home?.our realtor also told us that in order to sell our home to another party she would have to sign a cancellation agreement?how can that possible be??? She is completely in breach if contract..however we have to fight for the earnest money..AND we can?t relist or home?.this makes no sense to me!!! We just have to sit in limbo and wait???? any answers would be greatly appreciated!!

A:You probably have a very clear right to declare a default and keep the deposit, but only a lawyer can tell you that after reading the agreement. The agent is telling you what her office POLICY is regarding the deposit, not the law. Many times the agents do not even know that there is a difference. I suggest you try first to call the broker in charge of that office and request that they release the deposit to you without a ?cancellation? from the buyer. Tell them you will release them from liability if the buyer comes after them. If they refuse, your only course is through an attorney. Sorry for your troubles and good luck!

A: You need to refer to your original contract when the buyer does not close on the home. The real estate purchase contract should have specific dates that keep the contract valid. If there was no extension addendum signed by the seller and the buyer, it sounds as if the contract is null and void. You need to refer to your purchase contract to see if you can retain the earnest money as liquidated damages.

China closes in on Bo Xilai after jailing ex-police chief

Updated at 4:27 a.m. ET: BEIJING -- China's ruling Communist Party took a big step towards sealing the fate of fallen politician Bo Xilai on Monday, when a court jailed his former police chief for 15 years over charges that indicated Bo tried to derail a murder inquiry.

The court in Chengdu in southwest China handed down the sentence against Wang Lijun after finding him guilty on four charges, including seeking to cover up the November 2011 murder of a British businessman, Neil Heywood, by Bo's wife, Gu Kailai.

The verdict ended the career of one of China's most storied and controversial police officers and moved the party closer to a formal decision on dealing with Bo, whose downfall has shaken a leadership handover due at a party congress as early as next month.

"Wang Lijun exposed clues of major law-breaking and crimes by others," said the court verdict, according to the Xinhua news agency. It did not say who those other people were.

"He rendered a major contribution, and according to the law he can receive a lighter sentence," said the court. Wang could have received life imprisonment, or even a death sentence.

The relatively mild sentence -- following official confirmation that Wang shared incriminating clues and that Bo beat him after Wang confronted him over the murder allegations -- added weight to predictions that the party will move to jail Bo too, said He Weifang, a law professor at Peking University who has closely followed the case.

"The legal net around Bo Xilai has been slowly tightening," said He. "He'll certainly face a criminal trial."

'I let you down'
Experts have offered divided views over whether the party will put Bo before a criminal court or spare him and the leadership that disgrace by simply meting out lighter disciplinary punishment within the party. Some still see that latter course as more likely.

Before Chinese authorities can launch a criminal investigation, the party leadership must first hear the results of an internal investigation and decide whether to hand Bo over. That could happen at a leadership conclave that must take place before the bigger party congress convenes.

The court said Wang, former police chief of southwestern Chongqing municipality, received the sentence for "bending the law for selfish ends, defection, abuse of power and bribe-taking", according to Xinhua.

Wang would not appeal against the sentence, said his lawyer Wang Yuncai, who is not a relative. The sentence could be cut after he serves half his sentence, added Wang, the lawyer. "He accepted the sentence," she said. "He's doing okay."

Xinhua has portrayed Wang as being contrite. "I acknowledge and confess the guilt accused by the prosecuting body and show my repentance," Wang was quoted as saying in court last week. "For the Party organizations, people and relatives that have cared for me, I want to say here, sincerely: I'm very, very sorry, I've let you down."

The scandal that felled both men erupted after Gu murdered Heywood in a hilltop hotel villa in Chongqing, the city where Bo was the flamboyant party chief.?Officials have said the murder arose from a business dispute in Chongqing, which Bo and Wang ran as their fiefdom.

Wang had at first helped?Gu evade suspicion of poisoning Heywood, hushing up evidence of the murder, according to the official account of Wang's trial.

Slap that 'changed history'
However, in late January, Wang confronted Bo with the allegation that Gu was suspected of killing Heywood. But Wang was "angrily rebuked and had his ears boxed."

"That was a slap around the ears that changed history," said Li Zhuang, a Beijing lawyer who opposed Wang and Bo for mounting a sweeping crackdown on foes in the name of fighting organized crime. "Otherwise, Bo might still be in power and hoping to rise higher."

Days after the confrontation, Bo stripped Wang of his post as Chongqing police chief. The court verdict said several of Wang's subordinates were "illegally investigated."

Wang, fearing for his safety, fled to the U.S. consulate in Chengdu where he hid for more than 24 hours until Chinese officials coaxed him out.

Rebellious China village's experiment with democracy sours

Wang was found guilty by the court of defecting to a U.S. consulate -- along with taking bribes and conducting illegal surveillance -- but only two years of the 15-year sentence were that offense.

It was then that Wang exposed Heywood's murder first to American diplomats and then to Chinese authorities, handing over evidence used to convict Gu last month.

"When mafia members break up with their bosses, they can attempt to seek police protection. But in Chongqing and for the former police boss, there was nowhere to turn," prominent editor Hu Shuli wrote in a commentary posted on the website of her magazine, Caixin. "And this perhaps encapsulates one of the greatest embarrassments of the country's current legal system."

In March, Bo was sacked as Chongqing party boss, and in April he was suspended from the party's Politburo, a powerful decision-making council with two dozen active members.

So far, Bo has been accused only of breaching internal party discipline, and his defenders have accused foes of exploiting the charges against Gu to topple Bo. He had not been given a chance to defend himself publicly since his fall in March.

Ding Xueliang, a China expert at Hong Kong's University of Science and Technology, said those in the party leadership who wanted Bo out might push to reward Wang for exposing the corrupt and lawless inner workings of Bo's administration.

"Despite the many terrible things that Wang Lijun did before, he, in my view, contributed enormously to the legitimacy of the Communist government," Ding said. "This kind of local emperor style of Bo Xilai, it is a cancer of the system, and Wang Lijun helped the top leadership to deal with the fundamental disease before it's too late."
